Independent Contractor Agreement for Sitters
This agreement establishes the nature of the relationship between sitters and Sitters on the Go and outlines the expectations and obligations for sitters using the platform.

4.1 Relationship Definition
• Sitters on the Go serves as a platform to connect parents and sitters; it does not directly employ sitters.
• Sitters are independent contractors who operate at their own discretion and set their own schedules.
• Sitters are responsible for their own taxes, insurance, and compliance with local, state, and federal regulations.
• Sitters are not entitled to employee benefits, such as health insurance, paid time off, or retirement contributions, and acknowledge that they are not employees of Sitters on the Go.

4.2 Responsibilities
Sitters agree to adhere to the following responsibilities while using the Sitters on the Go platform:
• Profile Maintenance: Sitters must create and maintain accurate profiles, including truthful representations of their experience, qualifications, availability, and certifications. Falsifying information may result in account suspension or termination.
• Professional Communication: Sitters are required to communicate professionally and promptly with parents and the Sitters on the Go support team.
• Adherence to Platform Guidelines: Sitters must follow all rules and policies outlined by Sitters on the Go, including those related to safety, conduct, and payment processing.
• Prohibition on Solicitation: Sitters may not use the Sitters on the Go platform to solicit private clients or direct parents to external services outside the platform. Violations may result in immediate account termination.
• Compliance with Laws: Sitters must comply with all applicable childcare laws and regulations, including but not limited to licensing requirements, tax obligations, and background check mandates.

4.3 Confidentiality Clause
To ensure trust and safety within the platform, sitters must uphold strict confidentiality regarding information shared by parents. This includes:
• Personal Information: Sitters must not share or misuse any personal information provided by parents, such as addresses, phone numbers, or schedules.
• Childcare Details: Sitters must maintain the confidentiality of any childcare-related information, including children’s names, health conditions, or behavioral concerns, unless disclosure is necessary for safety or required by law.
• Platform Data: Sitters must not disclose proprietary information about Sitters on the Go’s platform, features, or user interactions.

4.4 Non-Compete Clause
• Sitters agree not to create or engage in a competing platform or service that leverages Sitters on the Go’s proprietary information for a period of 12 months following account termination.

4.5 Compensation and Payment
• Sitters are compensated directly by parents for services rendered. Sitters on the Go does not process or guarantee sitter payments.
• Sitters are responsible for setting their own rates within the parameters allowed by the platform.
• Taxes: Sitters are responsible for reporting and paying all applicable taxes on income earned through the platform, including self-employment taxes. Sitters on the Go will not withhold or remit taxes on behalf of sitters. Sitters are encouraged to consult with a tax professional to ensure compliance.

4.6 Background Checks and Verification
• Sitters are required to undergo a one-time background check as a condition of maintaining an active profile on the platform.
• Sitters must provide accurate information for the background check process and will be notified of any disqualifying results.
• Sitters may be asked to renew their background check periodically to retain verified status.

4.7 Termination of Account
• Sitters on the Go reserves the right to deactivate or terminate a sitter’s account for violations of this agreement, including but not limited to:
o Providing false information.
o Misconduct or unprofessional behavior.
o Soliciting private clients or engaging in competing services.
• Sitters may terminate their account at any time but must complete any outstanding bookings or notify parents of cancellations in advance.

4.8 Liability and Indemnification
• Sitters acknowledge that they are solely responsible for the childcare services they provide, including the safety and supervision of children.
• Sitters agree to indemnify and hold harmless Sitters on the Go from any claims, damages, or liabilities arising from their services.

4.9 Safety and Conduct
• Sitters must adhere to the safety guidelines provided by Sitters on the Go, which include meeting parents in public spaces initially and establishing clear agreements for childcare expectations.
• Sitters are expected to behave professionally, ethically, and respectfully in all interactions with parents and children.

4.10 Acknowledgment of Agreement
By signing this agreement or using the platform, sitters acknowledge and agree to the terms outlined in this document, including their status as independent contractors, their responsibility for paying taxes, and their adherence to the responsibilities and limitations defined herein.
